Hyderabad: S Venugopalachari,an MLA from Mudhole constituency in Adilabad district on Tuesday filed a quo warranto writ petition against chief minister N Kiran Kumar Reddy. A quo warranto,if issued by court,would make it mandatory for any incumbent of any public office to prove beyond doubt that he is eligible to the office he is holding. Senior Counsel S Ramachandra Rao made a special mention seeking the listing of the case and the same is likely to be taken up by a bench presided over by the acting chief justice Ghulam Mohammad on Wednesday. The MLA,elected on a TDP ticket, said that the current numbers in the state Assembly when calculated would establish that the Chief Minister did not enjoy the confidence of the Assembly and therefore was not qualified to head the government. In his affidavit in support of the relief sought he said that though the Congress regime needs 147 MLAs to remain in office,but after the resignation of the three members from the Congress party and the sad demise of Mahabubnagar MLA Rajeswar Reddy,it had only 143 and therefore the chief minister could not continue in office.The petitioner also made the opposition leader as respondent in the case saying that he too has become soft towards the current CM and is not pressing for a floor test. |
