ఆంధ్రప్రదేశ్-రాష్ట్ర విభజన నోట్ విడుదల

ఢిల్లీ: రాష్ట్ర విభజనకు సంబంధించి కేంద్ర హోంశాఖ మీడియాకు నోట్‌ విడుదల చేసింది. రాష్ట్ర విభజనకు సంబంధించి హోంశాఖ రూపొందించిన సమాచారాన్ని మంత్రుల బృందం (గ్రూప్ ఆఫ్ మినిస్టర్స్-జీఓఎం)  పరిశీలించింది. వచ్చిన ఈ మెయిల్‌ సమాచారాన్ని జీఓఎం చర్చించింది. ఈ మెయిల్‌లో వచ్చిన సమాచారంతో ఆయా శాఖలు తమ నివేదికలను మార్పు చేయాలని హొం శాఖ ఆదేశించింది. ఈ సమాచారాన్ని విశ్లేషించి ఆయా శాఖలు జీఓఎంకు నిర్దిష్ట సిఫార్సులు చేయాలని తెలిపింది.

11 శాఖలకు సంబంధించిన సమగ్ర సమాచారం కేంద్రానికి చేరింది. రాష్ట్ర విభజనపై సూచనలతో పెద్ద సంఖ్యలో ఈ మెయిల్స్‌ వచ్చాయి. సూచనలు స్వీకరించేందుకు కొంత సమయం ఇవ్వాలని జీఓఎం నిర్ణయించింది. రాజకీయ పార్టీలు, ప్రజాప్రతినిధులు, ప్రజలు తమ సలహాలు, సూచనలు జీఎంఓకు పంపించవచ్చునని హొం శాఖ తెలిపింది.

ఇదిలా ఉండగా, ఈ రోజు జరిగిన  కేంద్ర మంత్రుల బృందం (గ్రూప్ ఆఫ్ మినిస్టర్స్-జీఓఎం) సమావేశంలో రాష్ట్ర విభజన విధివిధానాలపై చర్చించినట్లు కేంద్ర హొం మంత్రి సుశీల్ కుమార్ షిండే చెప్పారు. గంటన్నరసేపు జరిగిన సమావేశం ముగిసిన తరువాత ఆయన విలేకరులతో మాట్లాడారు. రాష్ట్ర ప్రభుత్వం నుంచి ఆయా శాఖల కార్యదర్శులు సమాచారాన్ని పంపారని తెలిపారు. ఇప్పటి వరకు 2000 ఇమెయిల్స్ వచ్చాయని చెప్పారు.  వాటన్నిటినీ శాఖల వారీగా వర్గీకరించి ప్రభుత్వ కార్యదర్శులకు పంపుతామన్నారు. నవంబర్ 7 మరోసారి సమావేశమవుతామని చెప్పారు. సమావేశానికి ఆంటోనీ హాజరు కాలేదన్నారు. ఈ సమావేశానికి  సుశీల్ కుమార్ షిండేతోపాటు కేంద్ర మంత్రులు గులామ్ నబీ ఆజాద్‌, వీరప్పమొయిలీ, జైరాం రమేష్‌, చిదంబరం, నారాయణస్వామి హాజరయ్యారు.

సాక్షి, హైదరాబాద్:  తెలంగాణ రాష్ట్ర అధికారాలను కుదించకుండా, స్వతంత్రతకు భంగం కలగకుండా రాష్ట్రాన్ని ఏర్పాటు చేయాలని కోరుతూ కేంద్ర మంత్రుల బృందానికి (జీఓఎం) తెలంగాణ జేఏసీ ప్రత్యామ్నాయ నివేదికను పంపింది. టీ-జేఏసీ చైర్మన్ ప్రొఫెసర్ ఎం.కోదండరాం అధ్యక్షతన శుక్రవారం హైదరాబాద్‌లోని సెంటర్ ఫర్ దళిత్ స్టడీస్‌లో జేఏసీ స్టీరింగ్ కమిటీ ముఖ్యులు సమావేశమై సుదీర్ఘ సమాలోచనల అనంతరం తుది నివేదికను ఈ-మెయిల్ ద్వారా జీవోఎంకు పంపించారు. మూడు రోజుల పాటు కొనసాగిన సమాలోచనల్లో.. హైదరాబాద్, నీరు, విద్యుత్, విద్య, బొగ్గు, వైద్యవిద్య, ఆర్టికల్ 371(డి), వెనుకబాటుతనం వంటి ఇతర అంశాలపై ఆయా రంగాలకు చెందిన జేఏసీ నిపుణులు అందించిన నివేదికలపై చర్చించి తుది నివేదికను రూపొందించారు.

ఒక్కొక్క అంశంపై సంక్షిప్త నోటు, పూర్తి వివరణాత్మక నోటు, వాటికి సంబంధించిన ఆధారాలు, సాక్ష్యాలు, సమాచారం పూర్తిగా ఈ నివేదికల్లో పొందుపరిచారు. మొత్తం 125 పేజీల నివేదికను జేఏసీలోని 44 భాగస్వామ్య సంఘాల పేరుతో 14 ఫైళ్లుగా జీఓఎంకు శుక్రవారం రాత్రి ఈ-మెయిల్ చేశారు. తెలంగాణ విభజనపై కే బినెట్ నోట్‌కు కేంద్రం ఆమోదముద్ర వేసిన తర్వాత విభజనలో ఎదురయ్యే ఆయా అంశాలను పరిశీలించటానికి జీఓఎంను ఏర్పాటు చేసిన విషయం తెలిసిందే.

ఆ జీఓఎం సంబంధిత అంశాలపై అభిప్రాయాలను పంపించాలంటూ ఒక ఈ-మెయిల్ ఐడీ ఇవ్వటంతో పాటు సమాచారాన్ని ఇవ్వాలని కోరింది. ఆ మేరకు రాష్ట్ర విభజన ప్రక్రియ సాఫీగా పూర్తి చేయడంలో ఎదురయ్యే సమస్యలను పరిష్కరించడానికి ఉన్న సానుకూల అంశాలన్నింటినీ చర్చించి టీ-జేఏసీ ఈ నివేదికను పంపించింది. ఈ సమావేశంలో జేఏసీ ముఖ్యనేతలు మల్లేపల్లి లక్ష్మయ్య, కత్తి వెంకటస్వామి, సి.విఠల్, అద్దంకి దయాకర్, వెంకటరెడ్డి, దేవీప్రసాద్, రఘు, పిట్టల రవీందర్ తదితరులు పాల్గొన్నారు. జేఏసీ పంపిన ప్రత్యామ్నాయ నివేదికలోని ముఖ్యాంశాలివీ...

మూడేళ్లు ‘తాత్కాలిక’ ఉమ్మడి రాజధాని
హైదరాబాద్ ఉమ్మడి రాజధానిగా పదేళ్లు అవసరం లేదు. ఆధునిక సాంకేతిక పరిజ్ఞానం అందుబాటులో ఉన్న ఈ సమయంలో మూడేళ్లు సరిపోతుంది. ఈ మూడేళ్ల లోపే సీమాంధ్రలో కొత్త రాజధానిని అన్ని హంగులతో నిర్మించుకోవచ్చు. ఆ మూడేళ్లు కూడా ‘ఉమ్మడి’ అని కాకుండా ‘తాత్కాలిక’ రాజధానిగానే పేర్కొనాలి. హైదరాబాద్ మధ్యలో కాకుండా శివార్లలోని రామోజీ ఫిలిం సిటీ, కంటోన్మెంట్, హైటెక్ సిటీ వంటి వాటిలో సీమాంధ్రకు పరిపాలనా కేంద్రాలుగా చేసి, ఒక ప్రాంతానికే పరిమితం చేయాలి. దీనివల్ల ఇరుప్రాంతాల ప్రజల మధ్య ఘర్షణ, వైషమ్యాలు పెరగకుండా ఉంటాయి.

ప్రత్యేక రక్షణలు అవసరం లేదు...
తెలంగాణ రాష్ట్ర అధికారాలను కుదిస్తే ప్రజల్లో అశాంతి పెరిగి, మళ్లీ ఉద్యమాలు ఊపందుకుంటాయి. తెలంగాణ రాష్ట్ర అధికారాలను కేంద్ర ప్రభుత్వానికి లేదా గవర్నర్ పరిధిలో ఉంచాలనే యోచన వద్దు. భారతదేశంలో ఎవరికైనా, ఎక్కడైనా స్వేచ్ఛగా జీవించటానికి ప్రాథమిక హక్కులున్నాయి. సీమాంధ్రులతో సహా ఎవరికైనా రాజ్యాంగ రక్షణలు పటిష్టంగా ఉన్నాయి. ఇంకా ప్రత్యేకమైన రక్షణలు ఎవరికీ అవసరం లేదు. సీమాంధ్రుల్లో భయాలు, ఆందోళనలు ఉంటే వాటిపై చర్చకు పెట్టి, పరిష్కార మార్గాలను అన్వేషించుకుందాం. అంతకుమించి శాంతిభద్రతలను తెలంగాణ రాష్ట్ర ప్రభుత్వానికి లేకుండా చేస్తామంటే అంగీకరించే ప్రసక్తి లేదు.  ప్రాజెక్టుల వారీగా అప్పులు పంచాలి...
 రాష్ట్ర ప్రభుత్వానికి ఉన్న రూ. 1.70 లక్షల కోట్ల అప్పులను, ఆస్తులను నిర్దిష్టంగా విభజన చేయాలి. అప్పులను ప్రాజెక్టుల వారీగా పరిశీలించాలి. ఏ ప్రాజెక్టు కోసం అప్పు తెస్తే ఆ ప్రాజె క్టు ప్రాంతం ఉన్న రాష్ట్రానికే అప్పులను పంచాలి. జనాభా ప్రాతిపదికన అప్పులు పంచితే ఏదో ఒక ప్రాంతానికి నష్టం జరుగుతుంది. ప్రాజెక్టు కోసం చేసిన అప్పు  ఆ ప్రాజెక్టు ఉన్న రాష్ట్రానికే చెందాలి.

కేంద్ర ప్రభుత్వ గ్రిడ్‌ల నుంచి విద్యుత్ ఇవ్వాలి
తెలంగాణలో ఇప్పటికిప్పుడు సుమారు 2 వేల మెగావాట్ల విద్యుత్ కొరత ఉండే అవకాశముంది. ఈ కొరత వేసవిలో అయితే 5వేల మెగావాట్ల దాకా చేరుకోవచ్చు. తెలంగాణ ప్రభుత్వం సొంత ప్రణాళికలు రూపొందించుకునే దాకా కేంద్ర ప్రభుత్వ గ్రిడ్‌ల నుండి విద్యుత్‌ను సరఫరా చేయాలి. దీనికి కేంద్రం ప్యాకేజీ ఇవ్వాలి. సింగరేణిని కోల్ ఇండియాలో విలీనం చేయాలనే యోచన, ప్రయత్నాలు విరమించాలి.

బచావత్, బ్రిజేష్ ప్రకారమే నీటి కేటాయింపులు
నీటి కేటాయింపులు..: నదీ జలాల పంపకానికి ఇప్పటికే బచావత్, బ్రిజేష్‌కుమార్ ట్రిబ్యునల్స్ సూచనలు ఉన్నాయి. వాటి ప్రకారం ప్రాంతాల వారీగా కేటాయింపుల ప్రకారమే రెండు రాష్ట్రాలు నడుచుకోవాలి. చట్టబద్ధ నీటి కేటాయింపులు, ప్రాజెక్టుల వారీగా పంపిణీ కోసం ప్రత్యేక కమిటీ లేదా వ్యవస్థను ఏర్పాటు చేసి వివాదాలను పరిష్కరించుకోవాలి.

ఆర్టికల్ 371(డి) ఉండాల్సిందే...
తెలంగాణ ప్రాంత ఉద్యోగుల రక్షణ కోసం 371 (డి) ఆర్టికల్ ఉండాల్సిందే. ఇది లేకుంటే తెలంగాణ ప్రాంతానికి ఇతర ప్రాంతాల వలసలు కొనసాగే ప్రమాదం ఉంది. జిల్లాల మధ్య కూడా అసమానతలు పెరిగి సమస్యలు ఉత్పన్నం అవుతాయి. వీటికోసం రాష్ట్రపతి ఉత్తర్వుల ప్రకారం ఉద్యోగుల స్థానికతను బట్టి అవకాశాలుంటాయి.

GoM against UT status to Hyd - To Woo Seemandhra With Special Package

New Delhi: Taking the process of bifurcation of Andhra Pradesh a step further, the 7member Group of Ministers (GoM) in principle decided against according Union Territory status to Hyderabad. It will woo the Seemandhra region with a special financial package and assured the people of the two regions that all their concerns would be addressed with fairness and objectivity.

The GoM will carry out the bifurcation exercise on the recommendations of Justice B N Srikrishna Committee that gave an extensive report on Telangana in 2010. The Srikrishna Committee's report will be the basis of the whole exercise, Union home minister Sushilkumar Shinde,who heads the seven-member ministerial panel, told the media after the meeting. The GoM is to take a view on aspects such as Hyderabad status, law and order, formulating a legal and administrative mechanism for the division, sharing of river water, irrigation resources and other natural resources, especially coal, water, oil and gas between the two states and also inter-se with other states, including the declaration of Polavaram Irrigation Project as a national project.

The 40-minute long meeting decided to seek all the relevant information on the subjects included in the terms of reference of the GoM from the state government as well and begin the process immediately. Chaired by Shinde, the meeting was attended by Ghulam Nabi Azad, M Veerappa Moily, Jairam Ramesh and V Narayana Swamy (special invitee to the GoM). Antony, who is unwell, and P Chidamabaram, who is abroad could not attend the meeting.

 No deadline to submit T report New Delhi: The ministers also divided the subjects between themselves. After the meeting, Azad said the committee discussed how to go about the exercise and parameters to be taken into consideration for bifurcation of the state. He said a full-bench meeting would take place on October 19,2013. Azad also made it clear that the GoM had no deadline on submitting its report, adding that the process of creation of Telangana had started.

A note released by the home ministry said the GoM had discussed the approach and methodology to be adopted for eorganization of AP in Friday's meeting. According to sources, none of the ministers present in the meeting favoured UT status to Hyderabad and did not want to deviate from the CWC recommendation on Hyderabad. The important issue among other things that figured is the huge financial package for the backward regions of the Rayalaseema and Andhra regions.

The GoM assured the people of AP that the relevant issues as well as their concerns would be addressed with fairness and objectivity. It also assured that it would take the opinion of stakeholders on all important subjects while formulating its recommendations. The terms of reference for the GoM include determining the boundaries of the new state of Telangana and the residuary state of Andhra Pradesh with reference to the electoral constituencies, judicial and statutory bodies and other administrative units.

The GoM would also look into the legal and administrative measures required to ensure that both the state governments can function efficiently from Hyderabad as common capital for 10 years, besides taking into account the legal, financial and administrative measures that may be required for transition to a new capital of the residuary state of Andhra Pradesh. Sources also said the GoM was unlikely to visit the state but would receive delegations to take their views into consideration.

DECODING ARTICLE 356 - Prez rule is misleading term : Rule Is Anachronistic In Democracy Where People Are Sovereign

Though home minister Sushilkumar Shinde clarified that the Centre as yet had no intention to take over the reins of the AP Govt, this remains a probable scenario because of the alleged complicity of CM Kiran Kumar Reddy in the Seemandhra agitation opposing the decision to carve out Telangana with Hyderabad as its capital.

If Article 356 is invoked now, it will be the 2n time that the state will come under what is popularly but misleadingly called Presidents rule due to an agitation in the Seemandhra districts. The first time was way back in January 1973, when CM PV Narasimha Rao was forced to step down because of the Jai Andhra agitation. Ironically, it was then the people of the coastal districts who were demanding bifurcation of the state, in a reaction to the concessions secured by the Jai T movement. But then, given the titular nature of his office, the very idea of Presidents rule is ironic. Since the President anyway does not himself rule, it would have been more appropriate to call it Central rule if at all the term rule is to be used. It is not without significance that the term Presidents rule does not figure in Article 356. The implication of this emergency provision is simply that the governor, who is referred to as the agent of the Centre, runs the state govt, with the help of advisers appointed by New Delhi.

Loosely speaking, the governor assumes the role of the CM and his advisors are, like ministers, entrusted with different portfolios. One school of thought is that even the term rule is anachronistic in a democracy where the people are the sovereign and, therefore, the executive is directly accountable to peoples representatives in the legislature, whether at the Centre or in the states. In this perspective, it would be more appropriate to refer to governments administering territories as service or seva rather than rule. Those who hold this view argue that just as a CEO appointed by a proprietor to run his business does not rule the proprietor,so too must a government chosen by the people to administer them not be seen as ruling them.

Such a change in nomenclature would also be in keeping with conscious attempts by the government itself to shake off paternalistic notions of being a mai baap sarkar. Take the manner in which the branch dealing with the marginalized sections of the people has been changed from the Ministry for Social Welfare to the Ministry for Social Justice and Empowerment. Given that Article 356 is a departure from the constitutional value of federalism, the Centre would do well to exercise this power shorn of a terminology that is so unmindful of the autonomy of the state concerned.

This would be a fitting sequel to the reforms laid down by the Supreme Court in the S R Bommai case in 1994 when it said that any proclamation under Article 356 would have to be approved by both Houses of Parliament as a legislative check on the executive power. In a further safeguard, the landmark judgment held that the proclamation was subject to judicial review to probe whether it had been issued on the basis of relevant material or it was mala fide action. While a federal country like the US does not have any provision corresponding to Article 356,Indias founding fathers adapted it from a law passed by the British Raj.

Section 93 of the Government of India Act 1935,which was a prototype of the Constitution, empow-ered the British governor of a province to assume all powers if the popularly elected government was in his opinion unable to function in accordance with the law. In the drafting of Article 356, the Constituent Assembly replaced the governor with the President as the authority who would take a call on dismissing the state government.

Cong may not go for Prez rule in state               

Even as both the home ministry and Congress have declined to rule out the option of Presidents rule in Andhra Pradesh in wake of the Seemandhra crisis, indications are that they be more reluctant to exercise the option now. When asked if a central intervention under Article 356 would not be exercised to restore order in Seemandhra, the home minister replied,"I cannot say at this moment".
However, sources in the government indicated that there might be some complexities involved in going ahead with the bifurcation process with the state under central rule. Invoking Article 356 will involve dismissal of the Kiran Kumar Reddy government and putting the state assembly under suspended animation.

As per the process of bifurcation laid down in the Constitution, once the GoMs recommendations are in, a fresh Cabinet note,along with the AP Reorganisation Bill, will have to be put up before the Cabinet for approval. Once cleared, it will be sent to the President, who will then need to refer it to the state assembly for its views. Even though the AP assembly can be revived by a revocation of Presidents rule, a government has to be in place in the state to convene the assembly session. This would require putting in place a new chief minister.

However, choosing a new chief ministerial candidate will be tricky for the Congress, already under attack for bypassing the rights and concerns of Seemandhra to create Telangana for its political ends.
This is a situation that the Congress wants to avoid. The alternative that remains is to let the Kiran Kumar government continue and finish the deliberations of the Group of Ministers examining the issues relating to bifurcation of the state as early as possible. Reflecting the thinking in the Congress that Presidents rule was avoidable, party spokesperson P C Chacko on Thursday said the question of Presidents rule is not before the government right now.things are improving in the state.

Shinde,meanwhile, held out the assurance that the GoM would finalise its recommendations on bifurcation as early as possible.That is why no timeframe has been set for the GoM, he claimed.
However, when asked if the reorganization bill would be tabled in winter session of Parliament, the home minister was non-committal. We will see, he replied. Stating that first two meetings of the GoM would finalise how it would about its task, Shinde assured that justice will be done to AP.
When asked about the likely capital of Seemandhra, he said that though Kurnool had been suggested, with Guntur as the seat of the High Court, the same would be finalized after discussions with all stakeholders. Not agreeing with Reddy's assertion that the bifurcation was being hurried with, Shinde said the process to create T had begun in 2009 itself, with Chidambaram's statement to that effect.
However, the resulting protests led the government to set up Justice Srikrishna Commission and thereafter hold further consultations with the stakeholders. "I myself took an all-party meeting in 2012.It was after this continuous process over a long period that we decided to form T,"said Shinde.

Plea to book CM,ex-DGP for false propaganda

 A practising advocate filed a private petition in the Rangareddy court at LB Nagar alleging that chief minister N Kiran Kumar Reddy and former DGP V Dinesh Reddy conspired to spread disinformation that Naxal movement will strengthen if Telangana is carved out. T- Junior Advocates Association president N Naresh Kumar,in his petition, said Kiran Kumar Reddy tried to force Dinesh Reddy to give false statement and as such they are liable for commission of offence''.

He also alleged that both Dinesh Reddy and Kiran Kumar Reddy, despite being public servants, had willfully made ommissions and commissions to benefit Santosh Reddy, brother of the CM. The petition also alleged that Dinesh Reddy hid the designs of Kiran Kumar Reddy while he was in service, amounting to substantial loss to the public. The allegations in the petition were based on Dinesh Reddy's press conference on Tuesday.

The complainant requested the court to take cognizance of the petition and book Dinesh Reddy, Kiran Kumar Reddy and Santosh Reddy under sections 120-B (Conspiracy ),119 (Public servant concealing design to commit offence which it is his duty to prevent ),166 (Public servant disobeying law, with intent to cause injury to any person ),168 (Public servant unlawfully engaging in trade) and 181 (False statement on oath or affirmation to public servant or person authorized to administer an oath or affirmation ) of the Indian Penal Code (IPC).`The court took cognizance of my petition and recorded my statement.The court posted the next hearing of the case to October 15, Naresh said.

Kiran may launch own party in Dec

Chief minister Kiran Kumar Reddys new party is likely to take off in the month of December.Sources close to him told TOI that even though the CM still believes that he has the capacity to stall process of bifurcation, he is equally busy in mobilizing forces for his move to float a Seemandhra party in case his efforts fail. According to them,Kiran will wait for the defeat of T-resolution in the assembly and President Pranab Mukherjees response to the mood of the assembly before unveiling his party. Kiran allies indicated that he has been successful in persuading several ministers and MLAs who wanted to quit the Congress to join either the YSR Congress or Telugu Desam Party to wait till the defeat of the resolution in the assembly.    

He is said to have got the assuranceof support from leaders of the striking employees associations, especially APNGOs, to float the new party with Seemandhra ideology.

As part of this understanding, the employees, even though are likely to call off the general strike in about two to three days, are believed to have given an assurance to Kiran that they would keep the Seemandhra flame alive in some form or the other. Kiran is fully confident the he can stop the division of the state. If the T-resolution is defeated in the assembly, he would meet President Pranab and urge him to honor the will of the assembly and withhold his assent to the T bill. If the CM does not secure any assurance from the President, he would quit the Congress and Govt and announce his political programme, a minister who is closely associated with him in the Seemandhra movement, told TOI.

Among the cabinet ministers from the Seemandhra region, Kiran Kumar is said to be confident of getting the support of S Sailajanath (Anantapur dist), Erasu Pratap Reddy and TG Venkatesh (Kurnool), K Partha Sarathi ( Krishna), Pitani Satyanarayana (W Godavari ),Ganta Srinivasa Rao (Vizag), Kasu Venkata Krishan Reddy (Guntur) and Thota Narasimham (E Godavari).Among the senior leaders, JC Diwakar Reddy (Anantapur),Gade Venkata Reddy (Guntur) Rayapati Sambasiva Rao (Guntur),Ananta Venkatarami Reddy (Ananatapur ),Sabbam Hari (Vizag),Dharmana Prasada Rao ( Srikakulam) are expected to rally behind the CM when he goes his own way. It was because of the possibility of Kiran floating a new party that minister Earsu Pratap Reddy,MP A Venkatrami Reddy and former minister Dharamana Prasada Rao reportedly postponed their plans to join the YSR Congress till December.

According to the sources,the CM is also banking on the support of several MLAs. There are at least 50 MLAs who do not want to contest on Congress ticket in the Seemandhra region in 2014 and for whom there is no room in either the YSR Congress or the TDP.These legislators want a new party to come up and rescue them from being washed away by the wave of anti-Congress sentiment in the region, the minister said.

The CM camp believes that the general impression that YSR Congress chief Jaganmohan Reddy would move towards the Congress after 2014 and the TDPs mistake of giving letter of support to Telangana to the Centre would help enhance the image of Kiran Kumar Reddy among the Seemandhra public.

Act Judiciously -To stem the chaos in Andhra,the Centre must intervene with a clear and long-term plan

Five days after the Union cabinet approved a home ministry proposal to divide Andhra Pradesh the strike by government employees has had a debilitating impact,plunging five districts in Rayalaseema and coastal Andhra regions in darkness and hitting power supply in other southern states.The Centre must show urgency in dealing with a fast-deteriorating situation. The governments decision to remove all impediments that lay before the proposed Telangana state hasnt been accompanied by a clear plan on how the division of the state is to be brought about.Nor has there been much attempt to assuage understandable anxieties in the rest of Andhra,by offering a solution that looks win-win to everyone.In the event the decision to split Andhra,coming as it does just before Lok Sabha polls,looks as if it is guided more by political expediency,in order to undercut Jagan Reddy and garner some seats in Telangana for the Congress.Neither has Jagan,who is under investigation for large-scale corruption,helped matters much by attempting to seize the high moral ground and going on an indefinite fast on a pro-united Andhra plank.

The Telangana Rashtra Samithi (TRS) has also been busy adding fuel to the fire by threatening to oust people not hailing from Telangana.TRS chief K Chandrashekhar Rao must desist attempting to mobilise one section of the people against another.The basis of any fair division must be that people should have the right to live,buy and sell property in whichever state they want,without any coercion.And it is the Centres duty to ensure that citizens constitutional rights are preserved in both Seemandhra and Telangana.

The immediate task before the Centre now is to intervene judiciously.Imposing Presidents rule would be a short-term solution.To ensure that normalcy returns to Seemandhra,it must invoke the Essential Services Maintenance Act and dispatch sufficient central paramilitary troops to quell violence in a charged atmosphere.If TRS adopts a maximalist agenda,it can be countered by placing a moratorium on Telanganas statehood until a satisfactory arrangement can be hammered out on sharing river waters,distributing resources and preserving citizens rights.Failure to act decisively and effectively at this juncture could prove politically ruinous for the Congress even in Telangana

HC dismisses plea against bifurcation

 Finding fault with the petitioner for trying to link two unrelated issues (Article 3 of the constitution and the special provision 371D ),the AP high court on Tuesday dismissed a public interest litigation plea that wanted the court to rule that the Centre has no power to bifurcate Andhra Pradesh in view of the special provision 371-D in the constitution.The HC also made it clear that it has no power to interfere in the constitutional powers vested with Parliament in this regard. The petitioner,P V Krishnaiah,had contended that as long as there was Article 371-D,which was specifically inserted in the context of formation of AP in 1956 and provides for setting right regional injustices,the Centre cannot invoke Article 3 to bifurcate the state.The division bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice KC Bhanu brushed aside the argument and said it is an exclusive power of the President of India to exercise the power.It is Parliament alone that can act in accordance with the power exercised by the President in so far as bifurcation of a state is concerned,the bench said.

As for the petitioner's contention that the Centre cannot exercise its power under Article 3 as long as Article 371-D is in force,the bench clarified that Article 371-D was a special provision made for the purpose of AP giving protection in the fields of public employment and education,specifically for areas covered under the state.Article 371-D has no nexus or bearing on the operation of Article 3 as the latter functions in a different spectrum,particularly dealing with bifurcation and formation of a state.Therefore,the contention is devoid of merits,the bench said and dismissed the plea.

Kirans anti-T stand exposed -TRS Demands CBI Probe Into Land Deal Allegations Against CM

Political reactions on former DGP V Dinesh Redys accusations against chief minister N Kiran Kumar Reddy were mixed.While Telangana leaders cutting across party lines gunned for the chief minister,Congress leaders from the Seemandhra side chose to hit out at Dinesh Reddy. Demanding CMs immediate removal,Telangana Rashtra Samithi (TRS) MLA K Taraka Rama Rao sought a CBI probe against the CM.Dinesh Reddys disclosure is yet another proof of the partial stand of the chief minister and his anti-Telangana approach.Kiran tried to mislead the public and the centre on a sensitive issue.He has no rights to continue in the office.As the criminal charges leveled against the CM and his brother are serious in nature,we demand a CBI investigation into the matter, KTR said.He said he along with his party colleagues would meet the governor ESL Narasimhan on Wednesday to file a petition against the chief minister.

Senior Congress leader and Rajya Sabha member Palvai Goverdhan Reddy demanded the arrest of Kiran Reddy under the Preventive Detention Act for abusing government machinery and misleading the people of Seemandhra region.The centre should immediately dismiss the CM and appoint somebody who could win over the confidence of the people in his place, he said.A similar sentiment was expressed by former minister P Shankar Rao.He demanded that the Congress leadership in Delhi sack the chief minister immediately since his brother Santosh Kumar Reddy was involved in several illegal land deals.Shankar Rao also appealed to Dinesh Reddy to reveal all the misdeeds the family members of Kiran Reddy were involved in during the past three years.

However,Kiran Reddy got support from his party colleagues including finance minister Anam Ramanarayana Reddy and PCC president Botsa Satyanarayana.Questioning Dinesh Reddys credentials,Anam said the former DGP had no stature to blame the chief minister.He is leveling all baseless allegations just because he was denied extension.He must remember that the chief minister had done him a favour by considering him for the top post although he was fifth in the list.Instead of being grateful,he is accusing the CM.This only shows that Dinesh is just power hungry, said Anam. Without naming Dinesh Reddy,PCC chief Botsa said it was unbecoming of a retired police officer or a politician to level allegations against the government or the chief minister. Meanwhile, AICC general secretary Digvijay Singh dared Dinesh Reddy to prove his allegations.I wonder why he kept quiet when he was in office.Let him prove his allegations, Singh said

Commander Kiran turns conspirator -But CMs Future Uncertain After Jagan,Naidu Steal The Thunder-Kingshuk Nag TNN

Hyderabad: In the first week of September,deputy chief minister D Raja Narasimha made a telling comment that was a thinly veiled reference to chief minister Kiran Kumar Reddy.The commander is the conspirator, Telangana politician said when asked about the strikes by government employees in the wake of the CWCresolution on T at the end of July. In all fairness,Kiran Reddy who as speaker of the state legislative assembly had played a pro-active role in organizing the resignations of MLAs to stall the December 2009 announcement on Telangana - had told Sonia Gandhi on the eve of the CWC resolution that he would rather quit.But stories say that Sonia flared up at Kiran and asked him why he kept quiet after becoming chief minister knowing full well that the high command was mulling about Telangana.Other Congress leaders like Digvijay Singh sweet-talked him: You are our main man in AP.Dont do this as loyal Congressman, was the burden of the arguments.A chastened Kiran who had gone to Delhi returned to Hyderabad crestfallen and skipped office for a few days.But then his advisors convinced him that by continuing as chief minister,he would be in a better position to stall the bifurcation of the state.This was because he would have the entire state machinery in his hands.

Soon thereafter,government employees across sectors began to form joint action committees and embarked on go-slows,bandhs and strikes.This affected road transport,tax collections,educational institutions and even pilgrim movement to Tirupati.Even the state secretariat which has a large chunk of employees from the Seemandhra region struck work and daily held demonstrations within the secretariat complex.Interestingly,when in the last few years, employees belonging to Telangana had gone on strike to further their demand for separation, the Govt was quick to promulgate sections of the ESMA to stymie them.Cases were also booked against university students. But this time around,Kiran remained unmoved.Insiders claim that he even encouraged the employee unions to continue their strike though this cannot be proved.But officially,he never called them for negotiations to end the strike. Dinesh Reddy who retired as DGP on the last day of September told a press conference on Tuesday: When I asked for additional forces for Seemandhra,Kiran refused.He also told me to state publicly that Maoist forces would become dominant if Telangana was created. 

Kiran continued with his provocative comments and used his official capacity to tell the press how the high command was wrong to divide the state and declared his intent to resign.Behind the scenes,he encouraged his ministers to resign (with no intent to accept them) to put pressure on the high command to reverse the Telangana decision. However,Telangana leaders remained unfazed and so was the high command which was probably grappling with many other problems.A month ago when this correspondent spoke to TRS leader K T Rama Rao he said: They are striking in their own region and affecting their own lives.How are we concerned But there was a method behind the madness.The prolonged strike had the effect of spreading and deepening the sentiment for a united state.As a result,even poor laborers and many others who have never been to Hyderabad in their life are grieving at the prospects of division of Andhra Pradesh, says a Congress leader from Nellore.

Seventy days on when the protesters realized that the high command had not reacted,they began cutting power supplies reasoning that the effect of this would be felt across the entire region and pressure from other states would force the bosses in Delhi to react. In the meanwhile,Kiran Reddy has upped the ante by leaking out information that not only would he step down as CM but resign from the Congress and form his own party.Kirans gambit was working as his popularity soared in Seemandhra.But with Jaganmohan Reddy announcing that he would fight to save Andhra Pradesh and embark on an indefinite hunger strike,the initiative has gone out of Kirans hand.Chandrababu Naidu has followed suit.Whether the spiraling crisis will force the Congress high command to act and sack Kiran and impose Presidents rule,one does not know.But one thing is sure the Congress party is all but wiped out in Seemandhra.

Seemandhra employees want to call off strike - Staff Now Want Public,Politicos To Lead Stir

Citing the Dasara festival and the long struggle launched by them,the striking Seemandhra employees are urging their leaders to end the agitation and allow political parties to carry on the Samaikya movement.This being the sentiment, the leaders of the striking employees are likely to seek a compromise when they meet chief minister Kiran Kumar Reddy for talks on Wednesday so that there could be a face-saving end to the two-month long agitation launched by them. While they are committed to the Samaikya cause,the employees are also faced with livelihood issues as they are unable to pay house rent,EMIs,school fees and new clothes for Dasara as they have not received salaries since August.So they want to go back to work.They feel that the general public and political parties should take the lead and sustain the movement, said U Muralikrishna,chairman of the Seemandhra Employees Forum.

According to sources,if the CM offers a compromise,in the form of treating the strike period as leave and grants them immediate salary or advance ahead of Dasara, the strike might end on Wednesday.No one is in a mood to celebrate festival in this hour of distress.We have done enough to register our protest.Now,it is better to go back to work and leave the agitation to general public and pol parties, said K Narasa Reddy,a commercial tax official.

No question of calling off strike 

Hyderabad: However,leaders of the AP Non-Gazetted Officers (APNGO),an employees union which is in the forefront of the strike,said they would not call off the strike unless they get a clear assurance on keeping the state united. We have launched the struggle knowing very well the consequences.We are not deterred by the troubles.There is no question of calling off the strike without a clear commitment from the Centre to drop the proposal to divide the state, said APNGOs president P Ashok Babu.


However,he said the representatives of the striking employees would take part in the talks with the chief minister with an open mind and added that the further course of action would depend on the outcome of the meeting.
Meanwhile,expressing his concern over the plight of the employees,finance minister Anam Ramanrayana Reddy called upon them to call off the strike. Minister Anam,who also heads the cabinet sub-committee on employees affairs,said he would request the government to convert the strike period into leave and would also try to release festival advance for the employees if they call off the strike.

CM Kiran wanted me to say T would be Maoist den: Dinesh Was Pulled Up By CM For Deploying Addl Central Forces In Seemandhra


Just retired director general of police Dinesh Reddy on Tuesday put chief minister Kiran Kumar Reddy in the dock and launched a scathing attack on the latter for his anti-T moves.The former cop said that Kiran had pressured him to issue a public statement that the creation of T would lead to intensification of Maoist activities. This is with a view to aborting a decision in favor of a separate state by raising fears.Dinesh also charged that the chief minister had reprimanded him for seeking additional central forces for containing expected trouble in Seemandhra in the run up to the Congress Working Committees T resolution at the end of July.

During one of our visits to Delhi just before the CWC passed the T resolution,the media asked me about the possibility of increased Maoist activity in case Telangana was created.I responded by saying that this was a hypothetical question.The media interpreted my statement to say that Maoist activities would not increase if the state is divided.The CM questioned me and directed me to issue a statement saying that Maoist activities would intensify if Telangana is created.But I refused, Dinesh Reddy said.

The former DGP who was hopeful of an extension but did not get it - claimed that the state police wanted to deny permission for the huge public meeting convened by the striking Seemandhra employees at LB Stadium in Hyderabad on September 7,but alleged that Kiran Kumar pressured him to give permission.Though law and order was maintained during the event,the meeting had the potential of disrupting peace.When Seemandhra advocates sought permission to hold a public meeting at Gachibowli in Cyberabad,we refused, Dinesh said.But the CM was angry with me for denying permission for the meeting which was refused because it was bang in the middle of the IT corridor.But the advocates asked how could I stop them from holding the meeting when the CM had already given the green signal, Dinesh Reddy said.

Citing yet another example,Dinesh Reddy said after discussions with the Intelligence Bureau director and Union home secretary before July 30,it was decided to deploy 40 companies of paramilitary forces in the Seemandhra region.However,Kiran Kumar was unhappy and asked me on whose instructions I had deployed central forces in the state.I responded by saying that this was done as a decision in favor of Telangana might be announced.Then the CM pulled me up by saying Does a bureaucrat know or a politician know about what is best for the state

CMs brother asked me to settle land deals,says Dinesh 

Hyderabad: The former DGP charged that CMs brother Santosh Kumar Reddy meddled in the administration and alleged that the latter had approached him on several occasions to intervene in land deals and settle them in his (Santoshs ) favour.But I refused to entertain his request, Dinesh claimed.In a veiled reference to the Sohrabuddin fake encounter case and IG intelligence N Balasubramanyam (who has been charged with murder by the CBI in the case),the former DGP said he had written to the CM seeking permission to shift such an officer from the sensitive posting he was holding.However,after sitting on my request for two months,Kiran Kumar returned the file endorsing continuation of the said officer in the same post.How can the chief minister continue an officer charge-sheeted for murder in a sensitive posting'' Dinesh Reddy asked.

Asked whether he may join the YSR Congress,the former DGP said he has absolutely no intention of joining any political party and that he is not in the fray for the 2014 general election. Incidentally,Dinesh Reddy was once the favorite police officer of Kiran and the chief minister had appointed him as the top cop by superseding many others.The relations between the two were fine till the beginning of 2013 after which it started souring.It became worse from July in the run up to the T decision.
